EB-3 CLASSIFICATION
The EB-3 classification is a broad one that includes:
- Aliens with at least two years of experience as skilled workers;
- Professionals with a baccalaureate degree; and
- Other workers with less than two years experience, such as an unskilled worker who can perform labor for which qualified workers are not available in the United States.
To apply under this classification, the employer must first perform a recruitment exercise to attract qualified and available US workers for the position offered to the alien worker. The Department of Labor has set out certain guidelines and regulations on the required advertisements and job recruitment procedures and timelines. If no US worker is qualified and available to perform the job offered, the employer may then submit a labor certification application (or PERM) to the relevant Department of Labor's Employment and Training Administration (ETA) Office.
Once the labor application is certified, the employer may then proceed to file the petition for permanent residence for the alien worker.
